Meditation Beyond (the "Service") is operated by Joel Caplan ("we", "us", "our"). By creating an account, purchasing a subscription, or otherwise continuing to use the Service, you agree to these Terms & Conditions and enter into an agreement with Joel Caplan. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation. If you are using it as an individual, you confirm you are of legal age in your country.
The Service
Meditation Beyond is a browser-based audio studio that generates custom tones, binaural beats, reverb and timed meditation sessions. A free tier is available. A paid "Pro" subscription unlocks additional oscillator slots, unlimited session length and the ability to save your own mixes and reverb presets. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.
Your account
You must provide accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity that takes place under your account.
Acceptable use
You must not misuse the Service. In particular, you must not:
- use the Service for any unlawful purpose, or for fraud or spam;
- infringe anyone's intellectual property or other rights;
- interfere with the security or integrity of the Service, including introducing malware, probing or scanning our systems, or scraping the Service;
- reverse engineer, resell, redistribute, or circumvent the technical limits of the Service.
Health and safety
Meditation Beyond produces continuous tones and binaural audio for relaxation. It is not a medical device and does not provide medical advice, diagnosis or treatment. Do not use it while driving or operating machinery. Keep volume at a comfortable level. If you have epilepsy, a heart condition, a pacemaker, tinnitus or any other medical concern, consult a qualified professional before use.
Intellectual property
We retain all ownership of the Service and its intellectual property, including the software, audio engine, documentation and branding. The mixes and presets you create remain yours; you grant us a limited licence to host and process them solely to provide the Service to you.
Service level
We work to keep the Service available and accurate, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
Payment, billing and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellations and refund mechanics are governed by the Paddle Buyer Terms. Pro subscriptions renew automatically each month until cancelled. Cancelling stops the next renewal; your Pro access continues until the end of the period you have already paid for.
Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, you may export your saved mixes for a reasonable period before they are deleted.
Liability
To the fullest extent permitted by law, our aggregate liability is limited to the fees you paid in the twelve months before the claim, and we exclude liability for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing excludes liability for fraud, death or personal injury where that exclusion is not permitted by law. You indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.
General
These terms are governed by the laws of the seller's jurisdiction, and disputes are subject to the courts of that jurisdiction. You may not assign your rights without our consent; we may assign ours in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. We may update these terms; continued use after an update means you accept the revised terms.
